About these Terms

These Terms of Use (the “Terms”) govern access to and use of Linkcups: the platform at linkcups.com, the link domains we operate (including yourstay.today, dinein.today, cherish.wedding, yourvenue.events, buffet.promo and weekend.deals), the pages hosted on those links, our QR codes, tracking tools, integrations, apps and related services (together, the “Service”). Annex A (Data Processing Addendum) forms part of these Terms.

Agreement and who we are

These Terms are an agreement between you and the Linkcups provider named below. By ticking the box at sign-up, creating an account or using the Service, you accept these Terms and our Privacy Policy (linkcups.com/privacy). If you do not agree, do not use the Service.

If you use the Service on behalf of a hotel, restaurant, venue, brand or other organisation (a “Property”), you confirm that you are authorised to bind that organisation, and “you” means that organisation.

  • Provider: AEDIOS PTE. LTD. (“Aedios”, “Linkcups”, “we”, “us”), a private limited company incorporated in Singapore, which builds and operates Linkcups
  • Registration no. (UEN): 202604037K
  • Registered address: 160 Robinson Road, #14-04 Singapore Business Federation Center, Singapore 068914
  • Phone: +65 6964 0228
  • General contact: support@linkcups.com
  • Data Protection Officer (DPO): Sakda Su, hello@linkcups.com, +66 80-198-9499

What Linkcups is

Linkcups lets Properties and creators make meaningful, trackable links on our curated domains, generate QR codes, host mobile landing pages (profile links, voucher offers, affiliate shops and pages built from uploaded documents), track clicks and bookings, and connect third-party tools such as Google Business Profile, Google Analytics, Meta (Facebook and Instagram) and LINE.

People who scan or tap a link, visit a hosted page or interact with a Property through the Service are “Guests”. Linkcups is a tool for Properties; it is not a booking agent, a merchant, a payment processor or a party to any transaction between a Property and a Guest.

Accounts and teams

  • The Service is for business use. You must be at least 18 years old (or of legal age where you live) and able to enter into a binding contract.
  • Use a real, verified email address and keep your registration details current. We use your email to send notices about your account and these Terms.
  • You are responsible for everything done under your account and for keeping your login credentials and single sign-on secure. Tell us at support@linkcups.com immediately if you suspect unauthorised use.
  • Accounts may not be created or operated by bots or scripts, and you may not create multiple accounts to evade limits or enforcement.
  • An account can hold several Properties. Account owners and administrators decide which team members can see and manage each Property and what each member can do (for example, create links, edit pages or manage billing). You are responsible for the actions of every team member and creator you invite, and for removing access when it is no longer appropriate.

Links, domains and slugs

Ownership and licence

All link domains available in the Service are owned and controlled by Aedios. When you create a link, we grant you a limited, revocable, non-exclusive licence to use the chosen domain and link name (“slug”, for example yourstay.today/riverside-suite) for as long as your account is in good standing and the link is active. You do not acquire ownership of, or any trademark or domain-name right in, any domain or slug.

Slug rules

Slugs must not impersonate another person, Property or brand, infringe anyone’s intellectual property, or be registered only to resell or withhold them. We may reserve certain words. We may require you to change a slug, or may reassign it, where it breaches these Terms, is used for abuse, is subject to a valid third-party claim, or is needed to comply with law.

Links on the Free plan are subject to the limits shown in the Service. We may reclaim slugs attached to links that have had no clicks and no edits for 12 months, after giving you notice by email.

Dynamic and Evergreen links

Dynamic links use a 302 (temporary) redirect, so you can change the destination at any time and printed QR codes keep working. Evergreen links use a 301 (permanent) redirect. You are responsible for every destination you point a link to.

Destination health

We may suspend or disable any link, page or QR code whose destination becomes unreachable, malicious, deceptive, unlawful or inconsistent with these Terms, and we may show an interstitial warning to Guests where we believe a link is harmful. We check destination health periodically but do not guarantee that we will detect every problem.

Domain availability

We work hard to keep the domains and redirect service available, but the Service depends on domain registries, DNS providers and hosting providers that we do not control. We may retire a link domain with at least 90 days’ notice by email and will offer migration of your links to another domain where practical. Please keep your own record of your links and destinations.

Your content

“Content” means everything you or your team add to the Service: text, images, logos, menus, prices, offers, documents uploaded through Drop, links, button labels, review replies, automated messages, and the settings that shape how a page looks.

You keep ownership of your Content. You grant Aedios a worldwide, royalty-free licence to host, store, reproduce, display, adapt (for example to resize an image or render a PDF as a mobile page) and transmit your Content solely to operate, secure, support and improve the Service for the duration of your use. We will not use your name, logo or Content in our own marketing without your separate written permission.

You confirm that:

  • you own or have the rights to all Content you upload, and your link destinations are lawful;
  • your Content is accurate and not misleading, in particular prices, rates, availability, inclusions and voucher terms;
  • your Content does not infringe anyone’s privacy, publicity or intellectual property rights and is free of malicious code; and
  • your Content complies with applicable advertising, consumer protection and hospitality laws in every country where you offer your products.

Hosted pages are public by default. Do not put sensitive personal data in links, pages or files, and do not publish personal data about Guests, employees or other people unless you have the right to do so.

Acceptable use

You must not use Linkcups to:

  • send Guests to phishing, malware, counterfeit, fraudulent, pornographic, hateful or otherwise unlawful destinations, or cloak, disguise or misleadingly redirect destinations;
  • spam or send unsolicited marketing, or harvest personal data without a lawful basis;
  • publish unlawful content, infringe copyright or trademarks, or violate others’ privacy;
  • interfere with the Service, get around its limits, security or rate limits, or scrape or bulk-collect data from the Service or other users’ pages;
  • generate fake clicks, conversions or affiliate commissions through automated or deceptive means;
  • resell the Service or use it to build a competing link or page product; or
  • reverse-engineer any part of the Service except where the law allows.

We maintain blocked destination patterns and abuse reporting. We may pause links, pages or accounts that break these rules at once, without prior notice, where we reasonably believe there is a risk to Guests, other users or the Service.

Guest data and the Property’s duties

Roles

You decide which Guest data is collected through your links, pages and tracking code and what you do with it. For that data you are the data controller (under the Thailand Personal Data Protection Act B.E. 2562 (“PDPA”), the GDPR and the UK GDPR, and the “organisation” under the Singapore Personal Data Protection Act 2012) and Aedios is your data processor (a “data intermediary” in Singapore). Annex A sets out the data processing terms between us.

Your responsibilities

  • Have a lawful basis for processing and give Guests a privacy notice, including on any page where you collect Guest details.
  • Obtain consent where the law requires it, for example from Guests in the EU/EEA/UK before analytics or advertising tracking, and cookie consent where required.
  • Honour Guests’ rights under applicable data protection law.
  • Where you install Linkcups tracking code or a booking postback on your own website, make sure your website’s consent and notice practices cover it.

Bookings and offers

Bookings, reservations, vouchers, offers, products and services shown on your links and pages are offered and fulfilled by you. In the current version of the Service we do not collect payments from Guests; “buy” or “book” actions redirect to your booking engine, payment page or other destination. You are solely responsible for pricing, availability, fulfilment, cancellations, refunds, taxes, receipts, disputes and all legal obligations to your Guests.

Integrations and automations

You can connect third-party services such as Google (Business Profile and Analytics), Meta (Facebook Pages, Instagram, Pixel and Conversions API), LINE, booking engines and channel managers. When you connect a service you allow us to access and act on that service within the permissions you grant so that the related features work, and you agree to that service’s own terms and policies. You can revoke access at any time from the Service or from the third-party platform.

Linkcups’ use of information received from Google APIs follows the Google API Services User Data Policy, including the Limited Use requirements. We are not responsible for changes, outages, policy decisions or data practices of third-party platforms, including suspension of your Instagram, Facebook or Google account.

Automated replies (for example Instagram comment-to-DM automations and Google review replies) are sent in your name and under your account on the third-party platform. Review replies are posted to Google only after a person on your team approves them. You are responsible for the content of every automated or approved message, for complying with the platform’s messaging rules and anti-spam laws, and for supervising automations you turn on.

AI features

Parts of the Service use AI models, for example to suggest link names, draft review replies, extract text from uploaded documents or summarise analytics. AI output is a suggestion and can be wrong, incomplete or inappropriate; check it before you publish or send it. AI output is not legal, financial or professional advice, may not be unique, and is provided without warranty. We do not use your Content or Guest data to train general-purpose AI models.

Creators and affiliate links

Properties may invite creators (KOLs, influencers, travel agents and other partners) and issue them tracked affiliate links. The commission, approval, caps and payment terms of any affiliate arrangement are agreed between the Property and the creator. Linkcups tracks clicks and reported bookings and provides statements, but is not a party to the arrangement and does not guarantee any payment.

Attribution relies on cookies, click identifiers and booking postbacks that can be blocked, delayed or reported inaccurately. Attribution figures are therefore estimates, and the Property’s booking records prevail in any dispute. Creators must disclose paid partnerships and affiliate relationships as required by law and platform rules; where the Service displays a disclosure, you may not remove or hide it.

Plans, fees and taxes

The Service currently offers a Free plan with the limits shown in the app (for example the number of links per domain and per Property). We may change Free plan limits with 30 days’ notice. This version of the Service takes no payments. If we introduce paid plans, we will tell you in advance and ask you to agree before you are charged, and the following will apply unless the plan terms say otherwise:

  • Paid plans are billed in advance for the chosen period and renew automatically until cancelled; you authorise us or our payment provider to charge your payment method on each renewal.
  • Fees are stated exclusive of VAT, GST, withholding tax and similar taxes, which you are responsible for. If law requires you to withhold tax, you must gross up the payment so that we receive the full fee.
  • Except where the law requires otherwise, fees are non-refundable. If a payment fails, we may downgrade your account to the Free plan after notice.
  • We may change prices with at least 30 days’ notice; the change applies from your next renewal.

Analytics and data

We provide click, scan, source, country, language and conversion analytics so that you can understand your Guests. Analytics depend on data from browsers, devices and third parties that we do not control and may be incomplete; we do not guarantee their accuracy. We may create and use aggregated or de-identified statistics derived from use of the Service (for example industry benchmarks) that do not identify you, your Property or any Guest.

Intellectual property and feedback

The Service, including its software, design, templates, domains, documentation and the Linkcups name and logo, is owned by Aedios and its licensors and protected by intellectual property laws. Except for the licences expressly granted in these Terms, no rights are transferred to you. Templates, icons and themes we provide may be used only within the Service.

If you give us feedback or suggestions, we may use them without restriction or payment. Features marked beta or early access are provided for evaluation, may be changed or withdrawn, and may be subject to confidentiality: do not share non-public information about them without our permission.

Suspension and termination

You can stop using the Service and delete your account at any time from your settings, or ask us to delete it by emailing support@linkcups.com.

We may suspend or terminate your account, a Property, a link, a page or an integration if you breach these Terms; if required by law or by a court or platform order; if your Free plan account has not been used for 12 months (after notice); or if we reasonably believe it is necessary to protect Guests, other users, third parties or the Service. Where practical we will notify you first and give you a chance to fix the problem.

On termination your links stop redirecting and your pages go offline. You can export your link list and analytics before deletion. We delete or de-identify your account data within 90 days of termination, as set out in Annex A and the Privacy Policy, except where we must keep it under law or for legitimate purposes such as security and audit logs. Fees already paid are not refunded on termination for breach unless the law requires it.

Changes to the Service and these Terms

We keep improving the Service and may add, change or remove features, domains and integrations. We aim for high availability, but the Service may be interrupted for maintenance, upgrades or events outside our control.

When we change these Terms materially, or make a change to the Service that we reasonably expect to have a material negative effect on you, we will update the version, give at least 30 days’ notice by email or in-app notice, and ask you to accept the updated Terms at your next login. Other changes take effect when posted. If you do not accept a change, stop using the Service and delete your account before it takes effect.

Warranties, liability and indemnity

The Service is provided “as is” and “as available”. We work to keep it available, but to the extent permitted by law we exclude all warranties, conditions and representations not expressly stated in these Terms, including that the Service will be uninterrupted, error-free or secure, or will produce any particular number of clicks, bookings or revenue. You are responsible for keeping your own backups of your Content and link lists.

To the extent permitted by law, neither party is liable to the other for indirect, consequential, special or punitive loss, or for loss of profit, revenue, bookings, goodwill or data, however arising. Aedios’s total liability to you under or in connection with these Terms and the Service in any 12-month period is limited to the greater of the fees you paid us in that period and SGD 200. Nothing in these Terms limits liability for fraud, wilful misconduct, death or personal injury caused by negligence, or any liability that cannot be limited by law.

You will defend and indemnify Aedios, its affiliates and personnel against third-party claims, losses and costs (including reasonable legal fees) arising from your Content, your links and their destinations, your offers to Guests, your use of integrations and automations, your breach of these Terms, or your breach of law, including data protection law.

Governing law and disputes

These Terms and any dispute arising out of or in connection with them or the Service are governed by the laws of the Republic of Singapore. Before starting proceedings, each party agrees to raise the dispute in writing with the other and to negotiate in good faith for at least 30 days. If the dispute is not resolved, it will be submitted to the exclusive jurisdiction of the courts of Singapore. This does not remove any rights you have under mandatory consumer or data protection laws that apply to you (including the GDPR) and that cannot be excluded by contract.

General

These Terms (including Annex A), the Privacy Policy and any plan-specific or integration-specific terms we publish form the entire agreement between you and Aedios about the Service. If any provision is unenforceable it will be read down or severed and the rest remains in effect. Our failure to enforce a provision is not a waiver.

You may not assign these Terms without our consent; we may assign them to an affiliate or to a successor in a merger, acquisition or sale of the Service, and will notify you if we do. The parties are independent contractors. Notices to you are given by email to your account address or in the Service; notices to us go to support@linkcups.com.

Annex A · Data Processing Addendum (DPA)

This Annex applies when Aedios processes personal data on behalf of a Property (referred to below as “the hotel”, which includes restaurants, venues and other Properties). It is intended to meet GDPR Article 28 and PDPA section 40.

A.1 Roles and scope

  • Controller: the hotel/business using Linkcups. Processor: Aedios.
  • Subject matter and purpose: providing links, QR codes, pages, click and booking counts, review replies and the features the hotel turns on.
  • Duration: for as long as the Service is used, plus the deletion period after termination.
  • Data subjects: Guests and visitors of links/pages, Instagram commenters, Google reviewers, creators and hotel staff.
  • Data: pseudonymous visitor hash; click data (time, source, device, country, language, table); click ID; booking data without Guest identity; commenter username and text; reviewer name and text. No sensitive data.

A.2 Processor obligations

Aedios will:

  • process personal data only on the hotel’s documented instructions (including its settings in the app), and tell the hotel if an instruction appears unlawful;
  • ensure people with access are bound by confidentiality;
  • apply appropriate security measures (GDPR Art. 32) as set out in section 12 of the Privacy Policy;
  • use the subprocessors listed in A.5, bound by data protection obligations no less protective than these, and give the hotel at least 30 days’ notice before adding or replacing one; the hotel may object on reasonable grounds;
  • help the hotel answer data-subject requests (DSARs), for example by finding, exporting or deleting data, and forward any request we receive to the hotel;
  • help the hotel with data protection impact assessments (DPIAs) and prior consultation where needed;
  • notify the hotel of a personal data breach without undue delay, with the information it needs to notify authorities within 72 hours;
  • at the end of the contract, delete or return personal data as the hotel chooses within 90 days, unless the law requires us to keep it; backups expire on their normal cycle;
  • make available the information needed to show compliance with this Annex and allow reasonable audits on prior notice; and
  • handle international transfers as described in section 10 of the Privacy Policy (Standard Contractual Clauses Module 2/3 for EU/EEA data, with the UK Addendum).

A.3 Hotel (controller) obligations

  • Have a legal basis and give Guests a privacy notice, including consent where the law requires it.
  • Give lawful instructions and do not send us sensitive data or unnecessary Guest identifiers (for example in postback parameters).

A.4 PDPA terms

  • Under PDPA section 40 the processor must process only on the controller’s instructions; put in place appropriate security measures and notify the controller of breaches; and keep a record of processing activities.
  • These duties are included in A.2 and apply to processing of data about people in Thailand.
